Terms of Service (TOS)

OverviewThese Terms of Service (“Terms”) govern your access to and use of the website and related services (“Services”) provided by SetSites (“Company”, “we”, “us”, or “our”), a business registered in Ontario, Canada. By using our Services, you agree to be bound by these Terms.2. EligibilityTo use our Services, you must be at least 18 years of age and legally capable of entering into binding agreements under applicable law.3. Services ProvidedSetSites provides professional website services including hosting, unlimited edits, analytics, support, and related features. Service plans are available under two contract options:
• 12-Month Plan: Lower long-term commitment rate, fixed for 12 months.
• Month-to-Month Plan: Flexible, cancel at any time with no long-term commitment.Plan type must be selected during sign-up and may be changed with written agreement.4. Fees and PaymentYou agree to pay the subscription fee applicable to your selected plan:
• Standard Rate: $175 CAD per month, plus applicable taxes.
• Payment is due monthly in advance via credit card or an approved payment method.
• Overdue accounts may result in service suspension or termination.5. Cancellations and Termination
• 12-Month Plan: You may cancel after the initial 12-month term by providing at least 14 days’ written notice before your next billing cycle.
• Month-to-Month Plan: You may cancel at any time with at least 7 days’ written notice before your next billing date.
• We reserve the right to suspend or terminate Services for any breach of these Terms.6. Intellectual PropertyAll websites, templates, designs, content, and code created by SetSites remain the sole intellectual property of SetSites unless otherwise agreed in writing. You are granted a non-exclusive license to use the website we build for you as long as your subscription remains active and in good standing.7. Limitation of LiabilityTo the fullest extent permitted by law, SetSites shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability to you for any claim shall not exceed the total fees paid by you in the three (3) months preceding the claim.8. Governing LawThese Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.9. Refund and Cancellation Policy
Effective Date: May 7, 20251. Subscription ModelSetSites offers professional website services on a subscription basis at a rate of $175 CAD per month, plus applicable taxes. Customers may choose between:
• A 12-Month Commitment Plan with discounted long-term pricing.
• A Month-to-Month Plan, which may be canceled at any time with notice.Plan selection must be made at signup and is binding unless otherwise agreed in writing.2. RefundsAll payments are non-refundable, including partial-month charges, except in the following limited circumstances:
• Billing Errors: If you are mistakenly charged due to a system or processing error, we will promptly issue a full refund of the overcharged amount.
• Service Failure: If SetSites fails to deliver core services (e.g., hosting, support, or promised edits) and cannot resolve the issue within 14 days of written notice, a partial or full refund may be granted at our sole discretion.
Refunds are not provided for dissatisfaction with subjective preferences such as design or pace of iteration.3. CancellationsA. 12-Month Commitment Plan
• Early Cancellation: If you cancel before the end of the 12-month term, an early termination fee equal to the remaining unpaid balance will apply.
• Post-Term Cancellation: After 12 months, you may cancel anytime by providing at least 14 days’ written notice before your next billing date.B. Month-to-Month Plan
• You may cancel at any time by providing at least 7 days’ written notice before your next billing cycle.
• Cancellation takes effect at the end of your current paid period. No prorated refunds are issued for mid-cycle cancellations.C. Automatic RenewalAll subscriptions automatically renew under their existing plan type unless canceled in accordance with the notice periods above.4. Termination by SetSitesWe reserve the right to suspend or terminate your subscription without refund if:
• You violate our Terms of Service or engage in abuse, fraud, or unlawful activity;
• Your payment method fails repeatedly, or your account remains unpaid for 10 or more days after the due date;
• You engage in behavior that is hostile, threatening, or abusive to our team.We will attempt to provide notice and an opportunity to cure non-material breaches before termination.5. Service PausesYou may request a temporary pause in your subscription for up to 2 months per calendar year (for example, seasonal businesses).
